The recommendation was reached when Benjamin Wayo presented the report on the floor of the green chamber on behalf of the House committee on Public Petition.

According to Bar. Benjamin Wayo, the committee reached that decision after considering the presentation of all parties involved.
Wayo also said the continued refusal of INEC to obey the court ruling has short-changed the people which he also represent at the federal level.

Whilst speaking to Hallowmace correspondent after plenary, he alluded to the fact that his people refused to participate in the 2015 State Assembly elections until INEC do the needful but it took the persuasion of elders to convince  them to change their minds.

He also informed the press that INEC is willing to conduct the elections to resolve the imbalance.

The Federal High Court in Makurdi had ordered INEC to withdraw the Certificate of Return previously issued to Hon. Terkimbi Ikyange, the Speaker of the Benue State House Of Assembly who is the member representing the people of Ushongo at the State House of Assembly and to conduct elections within 90 days into the two constituencies.

The Independent National Electoral Commission has explained that it has no Locus Standi to withdraw the Certificate of Return of a validly elected candidate representing any constituency.

A Law firm, Jeoseph I Abaagu & Co, on behalf of the people of Ushongo Local Government has written a petition to the House of Representatives against the member representing Ushongo State Constituency and Speaker, Benue State House of Assembly.

In the petition, the law firm alleged that INEC refused to obey the order of the Federal High Court which compelled the commission to restore an additional constituency in Ushongo and conduct elections in the two constituencies.
